D&G (Dolce & Gabbana) blocks photo-taking in Hong Kong 擅禁途人拍照



年前長實阻止市民在尖沙嘴 1881 HERITAGE古蹟酒店拍照引起風波,類似事件在名店雲集的中環和廣東道再現。 DOLCE& GABBANA阻止途人在對出行人路拍照,《蘋果》記者放蛇直擊,被店員及歷山大廈和海港城的保安驅趕及用手阻擋鏡頭,其中海港城的保安更聲言內地遊客影 相就「冇問題」,香港人就要「過主」。有律師直指商舖櫥窗等同向公眾展示的物品,市民有權在公眾地方自由拍攝。





「內地人影相就冇問題」

記者兩次到現場實地測試,在 DOLCE& GABBANA店外距離四米的行人路,甫舉起相機即被店員上前制止,並指屬公司規定,記者質疑身處公眾地方為何不准拍照,店員更語帶不善警告:「你唔知乜 原因我叫保安嚟話畀你知!」海港城保安到場後以手遮擋記者鏡頭,惡形惡相稱該店招牌及櫥窗貨品有知識產權,未獲該公司授權不可拍照,接到該店指示要「做 嘢」,還「威脅」不離開即報警,又譏諷說:「對面馬路有莎莎,有滙豐銀行,你又唔過去影!」更表示:「內地人喺度觀光影相就冇問題,你要影就過對面馬路 影!」
本報記者又到中環歷山大廈商場內的 DOLCE& GABBANA外拍照,不到一分鐘即有店員出來制止,用手遮擋鏡頭說:「唔可以影櫥窗。」及後有兩名商場職員前來,記者表露身份後,職員說:「為保障商場商戶利益,唔想畀人影相,你可以影任何一度,我哋冇所謂。」
DOLCE& GABBANA回應指,該店投放了大量金錢於櫥窗及產品設計上,以提高消費者對該店認識,為打擊防假冒產品,才善意地勸阻市民拍照。海港城則表示,保安員是按商戶要求到場調解。
就商戶以版權理由阻市民在公眾地方拍照,熟悉版權法的律師江炳滔認為,法理上並不成立。他解釋:「除非證明有人利用商標以假冒商標持有人,達到販賣用途先可能構成侵權,喺條街對住商舖或者產品拍攝唔違反版權法。」

According to Hong Kong newspaper Apple Daily, Harbor City shopping center and D&G in Hong Kong are racist. The story is that: Local Hong Kong people took photos in the public space which may capture D&G and Harbor City in it. The D&G and Harbor City securities then blocks the local people to do so. However, those securities allow the visitors from mainland China to take photos.


Even worse, the securities admit they are discriminating the Hong Kong people. They said they only allow visitors from China to take photos. You may be wondering why the local shops and shopping center discriminate local people. The answer is simple since visitors from mainland China has a lot of money and bought a lot of things.
This is all kinds of wrong since the law in Hong Kong allows people to take photos of privated properties from public spaces. No one has the power to force people to stop to do so.
Apple Daily has the followed news report today. The D&G didn’t change and the situation is getting worse. Local Hong Kong people has setup the Facebook page to fight with it. However, D&G and Harbor City didn’t care and kept the situation goes worse.

Accusation of racism

In January 2012, it was reported by Hong Kong newspaper Apple Daily that Dolce & Gabbana would not allow Hong Kong citizens to take photos of their window display in both the Central and Harbour City stores. [13] They have converted the public space (Canton Road) into a "private, no photos zone". Representatives of Dolce & Gabbana claim that it was done to protect their intellectual property rights and prevent plagiarism of their products. [14] However, it was noted that tourists from mainland China were welcome by Dolce & Gabbana to take pictures. This angered numerous local citizens who decided to take photos of the window display as protest. Some Hong Kong lawyers state that Dolce & Gabbana's explanation does not have legal basis, and their privatization of public areas is an infringement of public access. Other luxury stores in the surrounding, such as Louis Vuitton, Gucci, Dior, Piaget, and Montblanc, were tested and they all allow photo shooting of their display windows freely. Dolce & Gabbana have yet to release an official statement over the matter. Instead, they have hired additional security. One security guard said on video "Don't be surprised, I will break this camera. [...] Don't take Photos, For the last time, I will break this camera" whilst covering the lens. [15]
